1. Service Description

Baraja de Lotería is a mobile application that allows you to play the traditional Mexican Lotería game. The App offers:

• Traditional decks with different image and voice styles.
• Creation of custom decks with your own images and audio.
• A community catalog where users can publish and download decks.
• Digital game boards.
• Premium functionality through subscription.

2. Acceptance of Terms

By creating an account or using features that require authentication, you confirm that:

• You are at least 13 years old (or the minimum age required in your jurisdiction).
• You have read and accept these Terms and our Privacy Policy.
• You agree to comply with all applicable laws.

3. User Accounts

• You can create an account via Google Sign-In or Apple Sign-In.
• You are responsible for maintaining the security of your account.
• You must not share your access credentials with third parties.
• We reserve the right to suspend or disable accounts that violate these Terms.

4. User-Generated Content (UGC)

4.1 Content Responsibility

The user who publishes a deck to the catalog is solely responsible for the content they upload, including but not limited to images, audio, and descriptions. By publishing content, you represent and warrant that:

• You own or have legal authorization to use all content you upload.
• The content does not infringe on copyrights, trademarks, patents, or other intellectual property rights of third parties.
• The content is not illegal, obscene, defamatory, threatening, harassing, discriminatory, or otherwise objectionable.
• The content does not contain viruses, malware, or harmful code.

4.2 Content License

By publishing a deck to the catalog, you grant ZimbronApps a non-exclusive, worldwide, royalty-free, and sublicensable license to:

• Store, distribute, and display your content within the App and catalog.
• Generate previews and thumbnails of your content.

This license exists solely for the purpose of operating the catalog service. You retain all ownership rights to your original content.

4.3 Moderation

• All published content goes through a review process before being approved.
• We reserve the right to reject, remove, or disable any content that violates these Terms, without prior notice.
• Reasons for rejection include, but are not limited to: inappropriate content, copyright infringement, spam, or misleading content.

4.4 Reporting System

Any user can report content they consider inappropriate or that infringes on third-party rights. Report reasons include:

• Inappropriate content: Offensive, violent, or unsuitable material.
• Copyright: Unauthorized use of images, audio, or other protected material.
• Spam: Repetitive, misleading, or unrelated content.
• Other: Any other violation of these Terms.

We commit to reviewing reports within a reasonable timeframe and taking appropriate action.

4.5 Copyright Infringement Procedure

If you believe your copyrighted work has been published without authorization, you can contact us at soporte@baraja.com.mx providing:

• Identification of the protected work.
• Identification of the infringing content within the App.
• Your contact information.
• A good faith statement indicating that the use is not authorized.

5. Subscriptions and Purchases

5.1 Premium Subscription

• The App offers a premium subscription that unlocks additional features.
• Payments are processed through the corresponding app store (App Store or Google Play).
• Subscriptions renew automatically unless canceled before the end of the current period.

5.2 Refund Policy

Refunds are governed by the policies of the app store where the purchase was made (Apple App Store or Google Play Store).

6. Advertising

The free version of the App displays ads provided by third-party services (Google AdMob). These services may collect information according to their own privacy policies.

7. Intellectual Property

• The App, its design, source code, official decks, and all original materials are the property of ZimbronApps.
• Images and voices of official decks are attributed to their respective authors, as indicated in the App's credits section.
• Copying, modifying, distributing, or creating derivative works of the App without express authorization is not permitted.

8. Account and Data Deletion

• You can request deletion of your account and all your data at any time from the App.
• Deletion includes: your account, profile, decks published to the catalog, files stored on our servers, and local data on your device.
• This action is irreversible. Once deleted, your data cannot be recovered.
• Decks you published that other users previously downloaded will remain as local copies on those users' devices, but will be removed from the catalog.

9. Limitation of Liability

The App is provided "as is" and "as available", without warranties of any kind. ZimbronApps shall not be liable for:

• Loss of user data.
• Content published by other users.
• Service interruptions or errors.
• Indirect, incidental, or consequential damages arising from the use of the App.

10. Disclaimer for Third-Party Content

ZimbronApps acts as a platform for users to share decks. We are not responsible for user-generated content. We take reasonable moderation measures, but do not guarantee that all content is legal, accurate, or appropriate.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Significant changes will be notified through the App. Continued use of the App after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms are governed by the laws of the United Mexican States. Any disputes shall be resolved before the competent courts of Mexico City.
